N.v. Sankaran This was my post yesterday(7/8/2014) on my time-line.Read this comment against amicus curie gopal subramaniym.

--------------------------------------------------------------

According to a news yesterday(6/8/14), Gopal Subrahmaniam wanted to be relieved off his duty as Amicus Curiae for the Sree Padmanaabha temple issue.

Today's news says that the Chief Justice wants him to withdraw his request and continue as the Amicus Curiae.

Is India in such a bad shape that there is no honest and untainted Lawyer that the CJI asked the tainted Gopal Subrahmanam to continue? Even when the government requested to review the Colegium's decision to appoint Gopal Subrahmaniam as one of the judges due to some serious allegations by the IB and CBI against Gopal Subrahmaniam, the CJI alleged that the government was playing politics in the appointment of SC judges.

Why was the CJI at that time so particular about appointing the tainted person whose name was actually recommended by the UPA government?

Actually, this should be read along with Mr. Markendeya Katju’s statement last week that a former CJI, Justice Lahoti succumbed to pressure from the UPA government and appointed a person as CJ of Madras HC.

The questions are:
1. Is the present CJI under pressure from the UPA leadership to retain Gopal Subrahmaniam as the Amicus Curiae, now that he is not in the race for the post of Judge?
2. Is the CJI so much biased against the Modi government that he wants a lawyer who was considered persona-non-grata by the government based on some valid allegations?
OR
3. Is the CJI considers that his ego has been hurt by the Government when the Law Department requested for a review of Gopal Subrahmaniam’s case, an act which experts in law say was perfectly legal?.
Nobody in this world is 100% unbiased and none can ever be. But, the Judges of any court, right from the lowest to the topmost should be capable of overcoming personal biases and deal with cases with utmost impartiality. Otherwise, the casualty will be Justice.
